ONLINE SHOP REGULATIONS AGBO

  1. definitions

    The terms used herein have the following meaning:

    1. Customer - a natural person, legal person or organizational unit without legal personality, the special provisions confer legal capacity, which carries out orders in the Shop;

    2. Consumer- A client who is a natural person and meets the criteria set out in the definition of art. 22 [1] Civil Code. According to this definition, the Consumer is any natural person making the entrepreneur with legal action not directly related to its business or professional activity.

    3. Civil Code - Act of 23 April 1964. (Journal of Laws No. 16, pos. 93, as amended.);

    4. Regulations - these Terms of Service electronically via the online store AGBO;

    5. Online Shop (Shop) - Internet service available at www.agbo.com.pl, through which the customer may in particular consist of orders;

    6. Commodity - presented in the Online Shop;

    7. Sales agreement - Commodity sales contract within the meaning of the Civil Code, concluded between AGBO Bogdan Nawrotek Ltd. and the customer, which is entered using the Internet service Store;

    8. The Law on Consumer Rights - Act of 30 May 2014. Consumer Rights (Journal of Laws of 2014. Pos. 827);

    9. Act on electronic services - Act of 18 July 2002. On the provision of electronic services (Dz. U. No 144, item. 1204, as amended.);

    10. Order - Customer declaration of intent, aimed directly to the conclusion of the Sales Agreement, specifying in particular the type and number of the Goods.

  2. General provisions

    1. These Regulations defines the rules for the use of the online store available at: www.agbo.com.pl and rules referred to in Article. 8 of the Act on electronic services.

    2. Online store operating at: www.agbo.com.pl is run by Bogdan AGBO Ltd. Nawrotek.

    3. This specifies conditions, in particular:

      1. rules of registration and use of the account within the online store;

      2. the terms and conditions for electronic booking available in the online store;

      3. the terms and conditions of the electronic procurement within the online store;

      4. rules of contract of sale with the use of services provided within an online store.

    4. Using the online shop is possible provided that the ICT system used by the customer following minimum technical requirements:

      1. a) Internet Explorer version 10 or later with JavaScript enabled, or
        b) Chrome version 49 or later with JavaScript enabled, or
        c) Firefox version 43 or later with JavaScript enabled, or
        d) Microsoft Edge version 13 or later with JavaScript enabled, or
        e) Opera version 36 or later with JavaScript enabled, or
        f) Safari 4 or later with JavaScript enabled.

      2. The minimum screen resolution of 480 x 680 pixels.

    5. In accordance with applicable law AGBO Bogdan Nawrotek Ltd. reserves the right to limit the provision of services via the Online Store to persons over the age of 18 years. In this case, potential customers will be notified of the above.

    6. Customers can get access to these Rules at any time via the link found on the main site www.agbo.com.pl and save the message and make a printout.

  3. Rules for the use of the Internet Store

    1. In order to ensure the safety of transmission of messages and data in connection with the delivered services within the Sites, Online Store takes technical and organizational measures appropriate to the seriousness of the safety of services, in particular measures to prevent acquisition and modification by unauthorized personal data transmitted over the Internet.

    2. The customer is obliged to:

      1. not to produce content and may not forbidden by law, eg. content promoting violence, defamatory or violating personal rights and other rights of third parties,

      2. use the online store without disrupting its functioning, in particular through the use of specific software or devices,

      3. use the online store in a manner consistent with the rules in force in the Republic of Polish law, the provisions of the Rules, as well as with the general principles of using the Internet.

  4. The procedure for conclusion of the Sales Agreement

    1. Information about the Goods quoted on the website store, and in particular their descriptions, technical and performance characteristics and price, are an invitation to contract, within the meaning of Art. 71 of the Civil Code.

    2. In order to conclude the Agreement of sales through the online store, go to the website www.agbo.com.pl, make the choice of goods, taking technical steps based on the customer displays messages and information available on the site.

    3. The choice of goods ordered by the Client is carried out by adding them to the basket.

    4. When submitting orders - until you click on the button "Orders from the obligation to pay" or other synonymously informing about the payment obligation - The customer has the possibility to modify the data entered and the Goods. To do this, follow the onscreen prompts the customer and the information available on the site.

    5. After administration by the customer benefiting from the online store all the necessary data, you will see a summary of the order. Order summary will contain information on:

      1. object of the contract,

      2. unit and total price of ordered products or services, including delivery costs and additional costs (if any)

      3. the chosen method of payment,

      4. the chosen method of delivery,

      5. delivery time,

    6. In order to send orders it is necessary to provide personal information marked as mandatory and, pressing the "Orders from the obligation to pay."

    7. Sending the Customer Order is a declaration of intention to conclude the AGBO Bogdan Nawrotek Ltd. Sales Agreement, in accordance with the Regulations.

    8. After placing orders, the customer receives an e-mail entitled "Confirmation of the order," including final confirmation of all the essential elements of the Order.

    9. Agreement shall be treated as concluded from the moment of receipt of the e-mail referred to above.

    10. The agreement is in Polish. Consolidation, protection and sharing data contracts and general terms (Terms online store) occurs via email.

  5. Supply

    1. Delivery of goods is limited to the area of ​​the Polish Republic and selected EU countries and takes place at the address indicated by the customer when placing orders.

    2. Delivery of ordered goods on Polish territory held by courier GLS
      Delivery costs are for courier GLS: 13,28 zł prepayment of a credit card from 17.59 zł

      Delivery of ordered goods to selected European countries is done by courier GLS. Delivery costs will be shown during the ordering and shipping prices start at 46,22 zł.

      Shipping fees will also be indicated at the time of the Order.

    3. The term of delivery is from 1 to 90 working days from the date of dispatch of the Customer Order.

  6. Prices and payment methods

    1. Commodity prices are given in Polish zloty and in euro, dollar, pound and the Czech koruna and contain all components, including VAT.

    2. The customer can pay the price to pay:

      1. transfer to the bank account number 55 1050 1953 1000 0090 3178 4029,

      2. electronic payment and credit cards via PAYPAL and Allegro,

      3. payment for downloading,

  7. The right of withdrawal

    1. The customer who is a consumer is entitled to a 14-day deadline for withdrawal. The consumer has the right to withdraw from this contract within 14 days without giving any reason. The deadline to withdraw from the contract will expire after 14 days from the date on which you acquire possession of things or a third party other than the carrier and indicated by you came into possession of things.

    2. To exercise the right of withdrawal, you must inform us AGBO Bogdan Nawrotek Ltd., ul. Mickiewicza 75, 08-530 Deblin, shop@agbo.com.pl about his decision to withdraw from this contract by an unequivocal statement (eg a letter sent by mail, fax or e-mail).

    3. To keep the deadline for withdrawal, enough to send your communication concerning exercising the right of withdrawal from the contract before the deadline to withdraw from the contract.

  8. Effects of withdrawal

    1. If you withdraw from this contract we shall reimburse to you all payments received from you, including the costs of delivery of goods (excluding additional costs resulting from your choice of delivery method other than the cheapest regular delivery offered by us), immediately and in any event no later than 14 days from the day on which we are informed about your decision to exercise the right to withdraw from this contract. Reimbursement of payments made using the same payment method that you used for the initial transaction, unless expressly agreed otherwise; in any case you will not incur any fees in connection with the return.

    2. We may withhold reimbursement until receipt of things or you have supplied evidence of her references, depending on which event occurs first.

    3. Please send or give us the benefit immediately, and in any event not later than 14 days from the day on which you communicate to withdraw from this agreement. The deadline is met if you send back the item before the deadline of 14 days. You will have to bear the direct cost of returning the items. You are responsible only for a reduction in the value of things resulting from the use of it in a different way than was necessary to establish the nature, characteristics and functioning of things.

  9. Complaints about the Goods

    1. AGBO Ltd. Bogdan Nawrotek as a seller is liable to the Client who is a consumer within the meaning of Art. 22 [1] Civil Code due warranty for defects within the scope defined in Civil Code, in particular art. And Article 556. 556 [1] - 556 [3] and subsequent Civil Code.

    2. Claims arising from the infringement of rights guaranteed by law or under these Regulations, should be addressed to shop@agbo.com.pl. Seller is obligated to consider any complaint within 14 days.

  10. Complaints in the provision of electronic services

    1. Online Store takes action to ensure fully correct operation of the site and store web pages, to the extent it results from the current technical knowledge and undertakes to remove within a reasonable time any technical irregularities reported by customers.

    2. Irregularities related to the operation and maintenance of websites store, customer may submit in writing to the following address: Bogdan Nawrotek AGBO Ltd., ul. Mickiewicza 75, 08-530 Deblin, e-mail to the address shop@agbo.com.pl or using the contact form.

    3. In the complaint, customer should describe the nature and date of irregularities related to the functioning of the Store.

  11. Dispute settlement and final provisions

    1. A customer who is a consumer, if interested can use extrajudicial methods of complaint and redress. Disputes concerning the online shopping can be resolved through mediation proceedings before the Provincial Inspectorates of the Trade Inspection process or arbitration proceedings at the Regional Inspectorate of Trade Inspection. The consumer may also use other methods of resolving disputes out of court. For example, submit your complaint via the ODR EU web-based platform, available at:http://ec.europa.eu/consumers/odr/

    2. In matters not regulated herein, the provisions of the Civil Code, the provisions of the Act on electronic services and other relevant provisions of Polish law.
